Section 3: RABIES VACCINATION REQUIRED
The owner of any cat or dog shall have the animal vaccinated against rabies by the time the animal is four (4) months old and once every twelve (12) months thereafter.
Section 4: DOG & CAT LICENSES REQUIRED
The owner or keeper of any dog or cat over four (4) months of age must obtain a license and pay the license fee required under this section for each. It shall be renewed annually.
Any unlicensed dog or cat shall be subject to seizure and impoundment at the discretion of the investigating animal control officer.
Dogs must wear dog license tags at all times while outdoors.
The owner or keeper shall provide the license tag or receipt for the animal to any authorized animal control officer upon request.
Section 5: RESTRAINT, IMPOUNDMENT & DISPOSITION OF DOGS AND CATS
A stray dog or cat shall constitute a public nuisance. "Stray" shall mean roaming beyond the premises of an animal's owner or keeper with no physical restraint. ("Restrain" shall mean to confine by use of a fence.)
Animal care officers or other law enforcement officers shall have the power to impound unrestrained animals as follows:
1. On public property.
2. On private property with the consent of the property owner.
3. On private property, except rear yards of residences, if the officer reasonably believes the animal will run at large if not impounded.
PENALTY
Any person who allows a dog to run at large in the County, unvaccinated, or unregistered, or unlicensed, or untagged, or a person who fails to register any dog or violated any part of this Order of the Commissioners Court shall be guilty of a Class C misdemeanor, and shall upon conviction be punished by a fine not exceeding $500.00 as provided for in Texas Penal Code 12.23 or any subsequent codification.
